Contractual Conditions

Contractual conditions subject to changes and revisions in compliance with current regulations

Terms and Conditions

By registering for the activities offered by the Alpine Guide, you accept the terms, conditions, and regulations of the activities highlighted here.

Responsibility

In the mountains, absolute safety does not exist and mountaineering is not without dangers, even if you are accompanied by a mountain guide. The guide undertakes to make careful assessments and to take reasonable decisions, informing the client, however, they will never be able to exclude all risks. This is why the client's sense of responsibility is also crucial to maintaining a good level of safety. By registering for an activity, you accept the residual risk inherent to the activity itself, thus waiving any claim for damages and the attribution of responsibility to the mountain guide.

Cancellation or modification of the itinerary due to bad weather or unsuitable mountain conditions

The Alpine Guide is the only person responsible for assessing the mountain conditions and therefore, during the excursion and in the presence of adverse conditions, may modify the course of the excursion at their own discretion. Furthermore, they are committed to cancelling the outing in case of adverse weather/mountain conditions. It is the Guide's duty and care to propose any alternative destinations with similar characteristics to the predefined outing. If this is not agreed upon, any amount paid in advance will be credited for a future outing or fully refunded. This decision will be made in mutual agreement with the client.

Safety is the highest priority and the Guide never guarantees reaching the summit or completing the excursion, although they will do their best to ensure the excursion is successful.

Program change

The mountain guide may modify the program or itinerary, at their own discretion, at any time, either due to the conditions mentioned above or if the clients' physical or psychological conditions make it necessary.

Cancellation by the customer

In case of cancellation by the customer, a different policy is applied depending on the duration of the activity:

  • one-day activity: free cancellation up to 15 days before the activity date, after which a compensation of 50% of the activity cost must be paid, within 7 days the full cost must be paid. Any advances on fixed expenses will not be refunded under any circumstances;

  • course or activity up to three days in duration: free cancellation up to 30 days before the activity start date, within 20 days a compensation of 50% of the activity cost must be paid, within 10 days the full cost of the activity must be paid. Any advances on fixed expenses will not be refunded under any circumstances;

  • activity longer than three days: cancellation up to 60 days before the activity start date will incur a 20% retention of the activity cost, after which a compensation of 50% of the activity cost must be paid, within 20 days the full cost of the activity must be paid. Any advances on fixed expenses will not be refunded under any circumstances.

Without prejudice to the above, the right of withdrawal is excluded pursuant to art. 59, paragraph 1, letter n) of Legislative Decree 6 September 2005, no. 206 (Consumer Code). According to this regulation, the right of withdrawal is excluded in the case of the purchase of services relating to leisure activities if the contract provides for a specific date or period of execution.

Prices

Prices are per person, VAT included, and cover the guide's fee and the use of common safety equipment. They do not include anything not expressly specified and agreed upon at the time of registration, such as personal equipment and the guide's out-of-pocket expenses.

The quote for the professional rate of the Alpine Guide is valid for 6 months from the date at the top of the quote itself.

Minimum number of participants

Some courses or excursions are only held if the minimum number of participants specified in the program is reached. If the minimum number is not reached, a revised price will be offered based on the actual number of participants. The customer may accept or refuse the proposal; in case of refusal, the activity will be cancelled.

Registration and booking confirmation

Registration, even verbal, implies acceptance of all the terms and conditions listed above. Registration for multi-day activities is only finalized upon payment of the specified deposit.

Customer obligations

The Customer undertakes to ensure that they meet the necessary conditions and requirements that may be mentioned in the activity description (physical and mental condition, any required level of experience, etc.). Otherwise, the guide may prevent the customer from participating in the activity, without granting any type of refund. The customer undertakes to comply with the "activity regulations".

Activity Regulations

Obligations of the participants

Participants are required to:

  • respect the daily departure times and the established program, adapting to any changes made by the guide;

  • show up with a physical and mental condition and clothing suitable for the activity or trip;

  • maintain disciplined behavior during the activity or trip,

  • respecting people and private property and following the instructions given by the guide;

  • interact with travel companions in a friendly and respectful manner, without excluding anyone, fostering the formation of a collaborative and welcoming group spirit;

  • follow the established route without straying or leaving the group and without overtaking the guide;

  • do not cause environmental damage (collecting plants, mushrooms, disturbing animals, etc.) and in any case adopt behavior that respects the environment;

  • keep your own waste until the appropriate bins.

Each participant is personally responsible for any risky behavior for themselves and for others, especially in the event that they take personal initiatives despite the guide's contrary opinion.

Photography and video shooting

During the activity or trip, photographs and/or video recordings will be taken that may appear on public websites and will be used by andrebasso.it and its partners for promotional purposes.

Participation in the excursion implies consent to the publication of the aforementioned material.

Acceptance of the regulations

Participation in the activities implies unconditional acceptance of these regulations.
